Final declaration

The Final declaration is the unilateral declaration by the debtor for injunctive relief after a preliminary injunction has been issued that the temporary injunction as a permanently binding regulation that is equivalent to a judgment on the merits. It also contains the declaration that temporary injunction not to be challenged with an appeal.

The temporary injunction only contains a provisional settlement. If the party obliged to cease and desist does not submit a final declaration, the injunction creditor can pursue its claim for injunctive relief in the main proceedings (action) in order to obtain a permanent settlement.
