What does copyright protect?

Copyright protects intellectual creations, i.e. works of literature, music, visual arts, photography, cinematography and architecture. This also includes computer programs, databases and works of applied art.

In order to be protected by copyright, a work must fulfill the following requirements:

  • It must be a personal intellectual creation. This means that it must be the result of an individual creative effort.
  • It must be perceptible. This means that it must be perceptible to the senses in some form, e.g. through writing, sound, image or film.
  • It must reach a certain level of creativity. This means that it must not be a mere stringing together of familiar elements, but an independent and original achievement.

Copyright protects various rights of the author:

  • The right of reproduction
  • The right to dissemination
  • The right of communication to the public
  • The right to edit
  • The right to be named
 
The term trademark attorney is not protected. Patent attorneys are often also referred to as trademark attorneys.

Special features of photos in copyright law

Photographs can be protected as photographs or photographic works.

  • Photographs are simple depictions of reality. They enjoy the performance protection of § 72 UrhG.
  • Photographic works on the other hand, are creative achievements of the photographer. They are protected by copyright.
The protection of the photograph is a so-called ancillary copyright. It therefore does not protect the particular creativity of the photographer, but only the performance of the photograph. This means that absolutely every photo protected by copyright experiences.
Photographers can therefore take action against the distribution of their images without further ado.

  2. Warning: Ideally, you should have the image thief warned immediately and not take action yourself. Taking action yourself often causes irreparable damage. In the warning letter, the copyright infringement is clearly stated and the user is requested to refrain from using your image. In addition to the cease-and-desist declaration, we will of course demand compensation for damages and reimbursement of the warning costs for you.
