This package is ideal for you if you are already in agreement with the other party. We take care of the correct application and correspondence with the trademark office.

Requirements for this award:

A signed trademark transfer agreement already exists OR
Both parties (old and new owner) are in agreement and grant us a power of attorney for the transfer.
No further contract drafting by us is necessary.

Package 2: Transfer incl. transfer agreement

Do you want to buy or sell a trademark but do not yet have a legally secure contract? A handshake is often not enough to clarify liability issues (e.g. for past trademark infringements) or the scope of the transfer (goodwill, domain rights, license agreements).

In addition: Preparation of an individual trademark transfer agreement (purchase agreement or transfer free of charge).

This is how the trademark transfer works

Commissioning: You contact us via the Form and briefly describe the facts of the case (brand name, registration number).
Documents: If necessary, we will send you the appropriate power of attorney templates for both parties.
Submission: We submit the application for transfer of rights to the authorities. As we act as a specialized law firm, the authorities often accept our applications more quickly than private submissions.
Execution: As soon as the office has confirmed the transfer, you will receive the official certificate and the trademark will belong to you (or the new owner).

Frequently asked questions about trademark assignment

How long does it take to transfer a trademark? Processing at the DPMA usually takes a few weeks, at the EUIPO it is often somewhat faster. By filing a correct application with a lawyer, you avoid queries (deficiency notices) that could otherwise delay the procedure by months.

What official fees are involved? In addition to our fee, there may be fees charged by the offices. The DPMA currently does not charge a fee for the transfer, at the EUIPO the transfer is also largely free of charge (provided it is a complete transfer). We will check the current fee levels for your individual case in advance.

Can I transfer only parts of a brand? Yes, a so-called partial assignment (for specific goods or services) is possible. However, this is more complex as the trademark is "shared". Please contact us for an individual offer.
